When you plead a claim for fraud, you have to plead what your evidence is. Rule 9(b) of the Federal Rules of Civil Procedure requires that fraud be pleaded "with particularity." Courts enforce that standard rigorously. You've got to spell out your evidence in your lawsuit papers or your case will be dismissed very early. You can't just say, "they committed fraud." You have to describe your evidence in the suit papers themselves.
They haven't done that, and haven't even tried to. If they had evidence, it would already be in the public record.
