1) Drug manufacturing and or sale is illegal.
2) Police raid house in middle of night to enforce drug laws.
3) Person at house fires on police.
4) Police return fire killing a person.

Yet Spanky thinks you can remove step 1 and the rest of the argument still be valid. Beyond that, he thinks you can remove step 1 and step 2 and replace it with any other crime, without any evidence the persons in step 3 and 4 had ever broken any other laws.
