While the case against the McCloskeys will likely go their way, there is no procedural basis for the court to dismiss the case at this stage on the merits. His brief doesn’t even cite a basis. It’s pathetic grandstanding.

Ultimately Kim is going to get her ass kicked by Joel, but this motion to dismiss is a joke.
