largely because you cannot ask the victim directly, as they are deceased.

In the case where you CAN ask the victim, I think it might be helpful to listen to their preferences. If they wish for 12 years incarceration, or financial restitution, or some other novel way of justice, perhaps it should be considered.

I don't have all the answers, but I think asking victims is a step in the right direction.
