but the way it works in federal court is there are guidelines for sentencing. The guidelines are advisory and non-binding on the court, but it is common for the court to sentence within the guidelines absent other circumstances.
The guidelines are calculated off a base number plus enhancements. The government enhanced the crap out of the guidelines like an 8 point enhancement for allegedly making threats.
The government managed to get the guidelines up to 29 and then they recommended the upper range. For a non-violent crime, the range is bat**** crazy.
My understanding is they backed off all of the enhancements and are down to 14 which is 15-21 months. In the eastern district of Missouri, a range that low would often get probation in a plea bargain.
