The situation is heartbreaking, but they should be prosecuted. They should not receive prison time, as the judge should use some discretion. Suspended sentence.

The decision to abort a pregnancy is too personal to be decided by anyone other than the mother and father, with the mother's view being the ultimate vote. Safe and legal abortion under medical supervision might help prevent this sort of situation.

We aren't as grand a species as we wish we were...
