He could have declined prosecution and ended the IRS investigations of normal people. In my experience in a regulatory agency, we didn't initiate a criminal investigation without guidance and approval of a U.S. attorney. Our agency attorneys didn't have authority to apply for search and/or arrest warrants on their own. Investigators may press for initiation by bringing information in to the U.S. attorney, but he had to turn us loose on the subject individuals and firms.
