and probably for some/most of the severity of the punishment, but that doesn't change the fact that he was convicted of a hate crime.

Had he stolen & burned an American flag while proclaiming that he hated Trump or hated America he may not have been charged for anything more than theft &/or property damage.

Because homosexuals are a specially protected group he was convicted of the additional crime of hate and received a more severe sentence. No?
