I was pointing out that the second poster in that thread totally mischaracterized the first, by changing the standard.

Obviously, Gyro misspoke. There can't be a crime if there is no crime. The absence of the thing prevents it.

The second poster changed that from crime to victim. And whether or not your system would recognize a crime in the absence of a victim or an infringement, the system in which we currently operate certainly does encompass crimes of intent.

For example: you're busted holding 10 kilos of cocaine. You haven't actually distributed anything, but you could be convicted on "intent to distribute". Whether you think we should have those crimes or not, they exist in our society.
