A cost benefit calculation is done with all of my clients on some level. It is often much more financially sound to cut a deal as opposed to standing on principal. It is done thousands, if not millions of times a day in the U.S. legal system; not to overlook the fact that the level of proof on a civil matter is significantly lower than the proof of a criminal conviction.
A civil judgment is not proof of a crime.
