Did the first shot hit the burglar, who was approaching and failed to heed warnings? Or was he shot be a stray round when running away?

If it was the latter instance, the best they could hope for is manslaughter because the death was caused by a negligent act.

Under the stand your ground law in Texas, he would be completely justified in shooting the burglar who was approaching him in a menacing manner.
