Jose Ines Garcia-Zarate, who was in the US without legal permission when he handled a gun that killed a woman in San Francisco, has had his conviction of being a felon in possession of a gun reversed by a California appellate court. The appeals court held that a judge erred in instructing the jury in Garcia-Zarate's trial.
