Not sure their is a clear cut answer when a product is marketed for one benefit, but causes other problems and how that may or may not be disclosed.

One thing that I do hate is how government profits off of these lawsuits through fines and such. I think all fines should go to a victim's fund, and those victim's that have been harmed should have that money available to them.

the other problem, as mentioned below, is that the State or victim goes after the guy with the deepest pocket, especially when it is a middle guy that likely caused the harm.

I think it comes down to is each case is different...and the merits of each case should be considered.
