if it is contrary to statute, that would mean Congress has spoken, and it wouldn't be a privilege reserved to the Executive Branch to do whatever he wishes (you know, that Article II thing he claims gives him the right to do whatever he wants).
At least that is how I'm reading it, but I could be wrong too.
