This opinion from a former AUSA is the most compelling arguement that I have seen:
“To the extent [Trump] had any argument about executive privilege (which was clearly already waived) it’s 100% gone now,” Mimi Rocah, a former federal prosecutor for the Southern District of New York, tweeted Thursday. “Can’t hide behind legal privilege & then go out & give your (lying) version of the facts. That’s the law & it’s just common sense.”
I tend to agree with Rocah, but imo trumps strategy here is to tie up this and many other issues in the courts. That he may lose is not of importance-delaying as long as possible is the plan-past the election being the ultimate goal. Whether or not that is a smart move is yet to be determined.
