Her choice is to
1) fold on the Wall in exchange for a 'do-over' on the law and avoid another declaration by Trump or future president.

2) don't fold and have a Roberts Court 'likely' hold that Congress gave the President the power to enact the emergency. The precedent of SCOTUS backing the Travel Ban based on a law passed by Congress shows that the odds are in Trump's favor on this.
