business is typically where we've done the binding, I think using an "MOU" as a contract vehicle is more common there.
I would agree that most that I've done fit the definition you state.
When it comes down to it, though, it doesn't matter what you call it. You can call it a "Dogfart bla bla" but if it ha the elements of a contract (offer, acceptance, mutuality of obligation) it is a contract.
This whole thread is stupid BTW.
