This is correct. The wild claims in the OP's linked two month old article are well off the mark. The Obama WOTUS rule applied to ephemeral ditches, drainage ditches, intermittent stream and small unnavigable streams and tributaries of navigable streams. The actual law specifically regulates navigable waterways only. The text and the intent of the law was to regulate point source pollution of rivers, lakes and navigable tributaries. The lesser drainage basins were to be left to the States.
