Looks like Whitaker cannot be Acting AG

Federal law only allows the President to appoint as Acting AG:
1) the Deputy AG (Whitaker isn't)
2) A current Justice Dept employee in a role that has received Senate confirmation (Whitaker isn't)
3) Anyone his heart desires if the Senate is in recess (which they aren't)
