Comey ASSERTED that her actions were careless (And that no prosecutor would take the case. )

She would still be innocent - even if some prosecutor would take the case - until proven guilty. That's how out system works. A good defense attorney would likely rip the prosecutions case to shreds (And that's why no prosecutor would touch it. )
