What time of the night was this? Was he bar-b-queing about 6 pm? Or was he hiding behind a bush with a crow bar & cell phone after breaking & entering cars & homes at about 3 am?

Did the police tell him to drop what was in his hands as he approached? How close to them was he when he extended his hand towards them with the cell phone in it, and how quickly did he do so? How good was the lighting?
