And the topic of abortion necessarily involves a SCOTUS decision finding rights in penumbras emanating from the Constitution that do not otherwise appear in the text, thereby resulting in a federal judicial mandate when the issue should be left to the states to decide. Unfortunately, Roe v. Wade is the law of the land. So if Congress passed a law banning abortions nationally, the Supreme Court, which they do not control, would strike it down.
