The GOP hold on the Senate is tenuous at best. Likelihood - if history is the gauge that it is - is that the party out of power will lose significantly in the mid-terms.
There goes your majority. And then the Democrats would need nothing more than a simple majority which they will very likely have - to appoint their guys. The filibuster is not something to toss out so cavalierly,
