But what is in the constitution is a provision in Article 1, section 8 that gives Congress explicit power to enact immigration legislation as long as it doesn't violate the Bill of Rights, and the 14th amendment.
So, Congress has constitutional authority to enact legislation. That is just as powerful as immigration being in the constitution itself.
