that is a failure rate of what actually goes in front of the SC. I read elsewhere that the SC about 75% of the time...why..because the SC decides what cases it will take..and guess what, it is vastly more likely to take cases for two reasons...1. It likely disagrees with the current ruling..or 2. There are disagreements on similar rulings across the different circuits.
Please explain why this message is being reported.
