there is evidence to suggest it is, and it is proper for that evidence to be considered. the court is not limited to the order itself in making that determination.

that it doesn't ban 100% of the world's muslims is not a dispositive factor, though it is an argument. i think it not persuasive. the appellate court didn't get to that, as it upheld the ban on the due process violation.
