Judge Napolitano and if u didn't know Ingram clerked for the Supreme Court so she does have some insight and expertise
Anyway she and the judge both said in their legal opinions trump is absolutely within his legal right on the EO
BUT, they both criticized him heavily for issuing the order before his attorney general was confirmed and before the solicitor general was selected.
They said it should have been assumed the order would be challenged and pretty much assumed it would be in the 9th circuit. Said all the legal responses to anticipated challenges should have been done and ready to where the only thing that needed fixed was the header depending on which circuit the challenge came from.
Also both said the Chief Justice should assign the different cases (Washington Minnesota New York) to one circuit.
And lastly much like I pointed out in a post the other day the both criticized how flimsy Roberta legal argument was when he issued the TRO. Said he offered no legal backing for showing the plaintiffs likelihood of success and also the states has no standing
