The author raises "Tutorgate" as a potential cloud on the horizon. He separates recruiting violations from academic fraud and notes the NCAA has severely penalized academic fraud cases in the past. He also notes that whatever is involved in Tutorgate is not going to be nearly as extensive as the North Carolina situation.

The NCAA Enforcement Staff treated the North Carolina situation as academic fraud. The case worked its way through the NCAA process and is before the NCAA Committee on Infractions (the appellate level of the NCAA enforcement process).

The Committee on Infractions has raised the issue that academic fraud is also an "impermissible benefit". The reasoning is players receive a benefit, i.e. academic credit, without being entitled to receive it, an an "impermissible benefit", i.e. a tutor writing a paper or taking a test is the same as a summer intern receiving payment for work not done.

Carolina is apparently pondering whether to litigate this issue in Federal Court and it may not be raised in Tutorgate, but if it is it might well have the effect of making Tutorgate more than just a minor academic fraud matter, particularly when added to the recent summer intern problem.

I am not suggesting this will be the case, only that the potential Tutorgate problem may be larger than commonly recognized.
