is no harm you can deduce from the actions you want outlawed.

If you call them "the same", then your approach would have women arrested and charged with a crime for having a drink while pregnant - irrespective of any provable harm to another human being.

You'd have to wait for the child to be born then evaluate what harm that one drink did - a scientific impossibility.

No, you want govt to enforce "risk management". as you do in all cases.
