~ Update on customer who shot two suspects attempting to rob a local pizza shop.
**No charges against customer who is a hero to a local pizza shop owner for saving them from an attempted robbery.**
Middletown Township Police reported an incident of a robbery occurring after 10 p.m. (last night), Tuesday, at Porfirio's II Pizza and Pasta in the 900 block of Veteran Highway (Route 413) near Trenton Road.
The two brothers that walked into Porfiro's II Pizza in Levittown to rob them, were 24 year old Sean Rose and his 22 year old brother Justin Rose. After pistol whipping a customer, the customer pulled out his own gun and fatally shot Sean Rose in the chest one time. His brother Justin, who had a gun pointed at an employee, was shot twice by the same customer. Justin Rose is in critical condition at Thomas Jefferson Hospital in Philadelphia. Police say the robbers guns turned out to be air soft guns. The customer who sustained minor injuries declined medical treatment on the scene and has been fully cooperative in the investigation.
District Attorney Matt Weintraub says the customer had a license to carry, though it was recently expired. Officials say he is a business owner, who carried the gun for his own protection.
Weintraub said, "He is a lifelong, law-abiding citizen and yes, you do get credit for that. A business owner who had the gun solely for his own protection and thank God he did."
"To me his is part of the family, now. He's a hero," Gilmer Porfirio said, owner of Porfiro's II Pizza.
