You can set a speed limit at 55 and not actually drive down to road for it to be valid.

Biden said on the floor of the senate during the fourth year of GHW Bush's term that a president shouldn't nominate a Supreme Court justice in the heat of a presidential campaign. It looks like the GOP senate leadership agrees with him.

Now that the campaign is over, we'll see if the President wants to push forward on the nominee he put up in violation of the rule his Vice President established during his tenure in the senate.
