the irs doesn't announce it unless they're pursuing criminal charges. They may have assessed civil fraud penalties - that wouldn't become public knowledge.
Whey there are memo's that donny's representation says that it's unlikely to be sustained and donny tries it anyway - that's fraud....of course he will be a defendant in another fraud trial at the end of the month.
