Obama's 'Pen and Phone' Cost Taxpayers $31 Billion, Study Finds

In June 2014, President Obama signed a memorandum directing the Education Department to propose regulations that would allow nearly 5 million student loan borrowers to cap their payments at 10% of their income. The move cost taxpayers more than $15 billion.

President Obama promised Americans that 2014 would be a "year of action." He said he wasn't going to wait around for Republicans in Congress to get things done, saying "I've got a pen and I've got a phone, and I can use that pen to sign executive orders and take executive actions and administrative actions that move the ball forward."

But Obama left out one important detail of his "I've got a pen" strategy: the enormous price tag he'd end up imposing on taxpayers.

A new report from the American Action Forum looked at the official government estimates for taxpayer costs of just nine of Obama's executive orders and administrative actions, and found that they imposed taxpayer costs that top $31 billion.

"There was no specific provision allowing the president to spend money or incur new debt," notes author Sam Batkins. But Obama did it anyway.

In June 2014, for example, Obama issued a Presidential Memorandum ordering the Secretary of Education to come up with a way to get more college graduates off the hook for their student loan debts.

A little over a year later, the Education Department issued a new rule that, according to the Obama administration itself, will cost taxpayers more than $15 billion.

Then there was Obama's decision to take pen in hand and unilaterally delay the start of ObamaCare's employer mandate for two years. This was a politically driven decision made before the 2014 midterm elections, so as to prevent businesses from having to bear the brunt of this unwelcome government mandate right before voters went to the polls.

But, as the Congressional Budget Office explained, this decision cost taxpayers $12 billion -- money the CBO says would have been paid in penalties from businesses that didn't comply with the mandate.

The AAF report also notes that the administration's decision to pay out ObamaCare cost-sharing subsidies in 2014 -- without getting required congressional authorization -- added an additional $3 billion to the taxpayers' tab.

Other Obama executive orders include overtime rules ($616 million), a risk management order ($295.7 million) and an executive order on gun checks ($5.5 million).

But even the $31 billion cost is probably a lowball estimate. The cost of those illegal ObamaCare cost-sharing subsidies, for example, is now more like $11 billion.

And the report doesn't count the taxpayer costs of executive orders that the courts stopped Obama from implementing -- most notably his amnesty order. The administration figured that this order alone -- which would have granted de facto amnesty to millions of illegal immigrants -- would require more than 3,100 new federal workers to implement and cost nearly $500 million.

Heritage Foundation welfare expert Robert Rector found that costs in added welfare benefits would be enormous. Just the added Earned Income Tax Credit would total $7.8 billion a year.

"President Obama acted unilaterally without legislative approval to cement his policy vision," Batkins writes. "Taxpayers will have to find $31 billion to cover this expensive vision."
