He has the right to do so.

He could even pull and nominate someone else before his term expires, but the Senate gets last say.

Don't be surprised if there is some kind of bargain reached. That is, Garland gets in, and Obama gets something else.

Or GOP sees the landslide coming, and votes him in within days of the election.
