so of course she wasn't indicted. all part of the plan.
law enforcement agencies, including the FBI, are not generally in the business of triaging or screening a prosecutor's cases for them. in this instance it made even less since, to the rational individual, for the FBI to fall on the sword and go public with some mumbo jumbo about no prosecutor would file the case. you just don't do that in investigations. you work the case and let the prosecutors sh*t can it to take any liability off of you
it was clear the statute was broken. no intent was required. the ONLY legal play for the FBI should have been to conduct the investigation and submit the case to the prosecutors and then let THEM take it from there.
the fbi intentionally fumbled this for whatever political reasons only Comey knows.
