If it was me, it would have obviously been an accident. I don't want to do anyone harm with my car.

BUT, if it was me, and I didn't see the guy and ended up hitting him, given the circumstances, I would get the hell out of the proximate area and call 911 ASAP.

I would NOT sit around or (even dumber) get out of my car and wait for the police. Which would have been a good call, as obviously the driver would have been shot had she stopped and got out of the car.

Other than not seeing the pedestrian and mowing him down, the driver did the right thing, absolutely.
