select a President because it would be tied, 25-25. The office would be vacant. And I left out one factor. The new Senate would have to be tied 50-50, and then it would be unable to select a VP. The next person in succession is the Speaker of the House.

So the factors are 269 tie in the EC, state delegations in the House are split 50-50, and the Senate is tied 50-50

That gives us President Pelosi.

All as set forth in the 12th Amendment
