Since the issue is his NOLs (per the Times article), there's a good chance that it relates to bankrupties/restructuring of debt (income attributable to those and reduction of NOL attributes) - which would be civil, not criminal matter.
Doubt that something like that gets to tax court, probably hung up in the appeals process. The bigger issue is that trump/munchkin don't pressure the government to drop their case.
