We would always give them the option to sign an at will separation agreement our lawyers made and get a severance or we would fire them and they get nothing.
Everyone always signed the at will and took the money.
There was a guy that stole 200k material from us and he got a severance. The entire premise was that the owner did want legal liabilities open in case someone claimed wrongful termination and it went to court. He also didn't want to have to pay his cut of unemployment if they filed for unemployment.
Basically it was worth a few thousand in severance to ensure everything was buttoned up and finalized.
