There is no burden of proof in an NCAA probe. The NCAA does not have to convince anyone "beyond a reasonable doubt" or by "clear and convincing evidence", etc. That's the point. The tutor's unsworn statement to NCAA investigators would have been sufficient.
As far as paying her "hush money", if memory serves, she had gone public and it had been picked up by the St. Louis media. She could have been paid "hush money" to retract those statements, but even if she had, her original statements were sufficient under the NCAA By-Laws for it to find a violation. That's the consequences of there being no burden of proof in an NCAA probe.
