I remember there wasn't anyone of a certain level of authority present (I think because of the 'voluntary' nature of the workout). The people running the drills took him inside the training facility rather than the emergency room across the street, and after the fact it was stated that his situation it wouldn't have saved him if they had. Still, his parents sued and the University settled.
