Lack of institutional control applies to only situations in which the school allowed violations of the NCAA by-laws to occur. You have to have a violation of NCAA by-laws before you can have a lack of institutional control. The misconduct at Baylor is not a violation of any NCAA By-Law, therefore no lack of institutional control. Find a by-law that deals with rape, then we'll talk.
