They also don't have the burden of proof of a criminal prosecutor. The NCAA can look at the fact pattern of crimes admitted to in correspondence, lack of institutional compliance, including Title IX violations, and make a determination of adequate punishment. If the school doesn't volunteer a complete investigation and conclude with it a severe enough self-penalty, the NCAA can perform its own investigation by camping out on campus as long as they want, reaching their own conclusions and imposing even more severe penalties and sanctions.
