Please keep in mind that the repeat offender provision is only a prescription for the so-called death penalty. That provision doesn't exclude using the death penalty in other circumstances. With that being said, the NCAA can concoct their own penalties that would be just as damaging as the death penalty, but without the exact provisions.

The NCAA is draconian by nature, and will be successful only with the support of it's member institutions. Do you really think that a majority of the NCAA members would jeopardize their reputations and the success of the NCAA by defending the indefensible?
