Three avenues to compliance
Schools may choose any of three options for satisfying Title IX's participation component. Those options include the controversial proportionality gauge. Satisfaction of any of the three standards lifts a school into participation compliance. The three-prong test has been upheld by the U.S. Supreme Court. A school may:
1) Provide athletic participation opportunities that are substantially proportionate to the undergraduate enrollment.
2) Demonstrate a continual expansion of athletic opportunities for the underrepresented sex.
3) Fully accommodate the interests and abilities of the underrepresented sex.
The test offers three separate ways of assessing whether schools are providing equal opportunities to their male and female students to participate in athletics.
