if the Big 12 updated its rules or something?

"Big 12 Conference presidents voted Wednesday to limit each school annually to two partial academic qualifiers of each gender and to ban signing non-qualifiers, effective immediately.
Big 12 schools can award two men's scholarships and two women's scholarships to student-athletes who do not qualify under both the tougher NCAA grade-point-average and standardized-test requirements that take effect next fall. No more than one scholarship may be in the same sport."
The fact that neither Ben McLemore or Jamari Traylor seemed to have any issue paying out of state tuition this year as students not eligible for athletic scholarships aside.....how can both of them be eligible next year if neither qualified and the Big 12 rules state that a school can have a max of 2 of the same gender and they can't be in the same sport?
